A. COUNTRY TRADERS AUSTRALIA PTY LTD ACN 157 810 743 trading as “Country Culture” owns the Website www.countryculture.com.au.
B. The goods available on the Website are sold by Country Culture as agent on behalf of various traders.
TERMS & CONDITIONS
These Terms & Conditions apply to your use of the Website. By accessing or using the Website you agree to be bound by these Terms & Conditions:
1. Users of the Website
The Website is intended for use by customers worldwide. Depending on the shipping options available for particular products, however, some products are only available for purchase in Australia.
If contacted by an overseas customer, Country Culture may provide a quote for postage. Providing the overseas customer provides a legal credit card or makes a direct deposit into Country Culture’s bank account, products may be sent to customers overseas.
(a) While Country Culture operates the Website, all Goods are available for purchase from the Trader and are sold by the Trader. Country Culture does not purchase the Goods from the Trader.
(b) Country Culture sells the Goods as the Trader’s agent and not on its own behalf. This includes making the Trader’s Goods available for purchase, taking purchase orders and collecting payment for Good purchases. The Trader has appointed Country Culture as the Trader’s agent for such purposes.
(c) Country Culture is not a party to, and has no obligations under, any contract that may be formed between the Trader and a customer in relation to any Good.
(d) It is recommended that customers read the terms and conditions on which Traders on the Website make their goods available for purchase (the “Default Purchaser Terms”). The Default Purchaser Terms can be accessed through the appropriate link on the Website. If a Trader’s terms vary from the Default Purchaser Terms, it will be stated as part of the Trader’s Individual Store.
(e) Country Culture’s Terms & Conditions apply to the manner in which Country Culture makes this Website available to customers. A customers’ rights in relation to the purchase of Goods, however, is governed by the relevant Default Purchaser Terms. If a customer wishes to return any Good(s) or has any complaints in relation a Good purchased through the Website, the customer should contact the relevant Trader using the “Contact this Trader” section of the Website.
(f) Product information and images on the Website are provided by the Traders, including all of the information relating to the Goods that may be purchased from those Traders. Country Culture is not responsible for such information.
(a) Country Culture may from time to time and without notice, modify or discontinue, temporarily or permanently, any or all of the Website (including the Traders that may be included from time to time on the Website) .
(b) Country Culture may revise these Terms & Conditions from time to time.
(c) Country Culture is not responsible for the content or accuracy of any sites linked to the Website.
(d) Country Culture encourages you to provide links to the Website:
(i) Country Culture authorises you to use the name "countryculture” in the text of any such link, however you may not use the Country Culture logo or any of our other trademarks without our prior written consent.
(ii) You must not frame the Website, or make representations that any part of the Website belongs to anyone other than Country Culture.
(iii) If Country Culture notifies you that it objects to the manner in which you provide links to the Website, you must immediately cease providing such links.
(a) In the unlikely event that the product you have purchased is faulty or is different to its description and or image, the customer may return it within 14 days of receipt of the purchase. Please inform Country Culture via email at firstname.lastname@example.org immediately. Country Culture will inform that particular trader about the faulty item and that trader will send the customer a stamped, self addressed post pack so that the item can be returned directly to the trader by the customer. Once the faulty item received, the customer will be offered either a full refund or a store credit to the same value. Payments will be made via Paypal or a Camtech credit card gateway.
(b) If a customer changes their mind when they receive an order, the customer must
inform Country Culture within 14 days of receipt of the purchase. Please inform Country Culture via email at email@example.com immediately. Country Culture will inform that particular trader of the request. The product then needs to be posted back to that particular trader whose address is on the Sender’s Sticker on the post pack it was delivered in. Once the trader has received the item in perfect condition, the customer will be offered a store credit to the same value as the price of the product. The shipping costs in this instance will not be refunded. Payments will be made via Paypal or a Camtech credit card gateway.
(c) In the rare circumstance that a customer orders a product, which is not be available for sale due to an unforeseen reason, Country Culture will offer the customer a store credit or refund to the same value as the item including shipping costs.
(d) Any traders who hand make an order especially for a particular customer will not accept returns or a change of mind.
5. Gift Certificates
(a) Customers may purchase gift certificates through Country Culture to the value of their choice. The gift certificates will be emailed and/or sent by mail depending on the request of the customer. Gift certificates may be used by the customer with any trader and are valid for 6 months from the date of purchase.
6. Warranties and liability
(a) All express or implied warranties, representations, statements, terms and conditions relating to these Terms & Conditions or the Website that are not contained in these Terms & Conditions, are excluded to the maximum extent permitted by law.
(b) In particular, and without limiting paragraph (a):
(i) Country Culture does not guarantee a functional or error free Website; and
(ii) Country Culture cannot be responsible for any loss, corruption or interception of data sent to or from the Website which occurs outside of its computer systems (such as those which occur while being sent over the internet).Country Culture recommends that you install and use up-to-date anti-virus and firewall software on your computer.
(c) Nothing in these Terms & Conditions excludes, restricts or modifies any term, condition, warranty, right or remedy implied or imposed by any statute or regulation which cannot lawfully be excluded, restricted or modified, which may include the Australian Consumer Law.
(d) If any term, condition or warranty is implied into these Terms & Conditions and Country Culture is able to limit your remedy for a breach of such a term, condition or warranty, then Country Culture’s liability for breach of the term, condition or warranty is limited to one or more of the following at Country Culture’s option:
(i) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or
(ii) in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.
(a) Neither Country Culture nor the customer/website user will be liable for any delay in performing any of its obligations under these Terms & Conditions if such delay is caused by circumstances beyond the reasonable control of that party.
(b) If any of these Terms & Conditions are held to be unenforceable, the unenforceable part is to be given effect to the greatest extent possible and the remainder will remain in full force and effect.
(c) These Terms & Conditions are governed by the laws of New South Wales.
(d) These Terms & Conditions constitute the entire agreement between Country Culture and the customer/website user in relation to the Website.
(e) You agree that Country Culture may communicate with you electronically for all aspects of your use of the Website, including sending you electronic notices.
(f) The provisions of these Terms & Conditions which, by their nature survive termination or expiry of these Terms & Conditions, will survive termination or expiry of these Terms & Conditions.
(g) The term “including” when used in these Terms & Conditions is not a term of limitation.
